Welcome to ACTivate Life. These Terms & Conditions (“Terms”) govern your use of our services, including access to waitlists, courses, programs, workshops, online content, and all related products (“Services”). They form a legally binding agreement between you and ACTitude GmbH / ACTivate Life (“we”, “us”, “our”).

By registering, purchasing, subscribing, or otherwise using our Services, you accept and agree to these Terms. If you do not agree, please do not use our Services.

1. Scope and Applicability

1.1 These Terms apply to all contracts between you and ACTivate Life relating to access to and participation in our Services, including but not limited to online courses, live workshops, waitlists, and digital content.

1.2 Any conflicting terms issued by you are expressly rejected, unless we have agreed to them in writing.

1.3 The version of these Terms valid at the time of your registration, order, or purchase shall apply.

2. Contract Formation

2.1 A contract between you and ACTivate Life is concluded once you sign up for a waitlist, enroll in a course, purchase a Service, or otherwise complete the relevant registration process and receive confirmation from us.

2.2 Course descriptions, schedules, and conditions on our website and other promotional material do not constitute binding offers but invitations to enter into a contract.

3. Services and Use

3.1 Course formats may include online courses, live online sessions, workshops, self-paced modules, gamified challenges, and other digital learning formats.

3.2 Unless otherwise specified, all online course content is accessible only after successful payment and login using credentials provided by ACTivate Life or a third-party learning platform (e.g., Xperiencify).

3.3 You are responsible for providing and maintaining the technical equipment and internet connection required to access Services.

4. Waitlists

4.1 Signing up for a waitlist (e.g., for Qigong, Tai Chi, Longevity Programs) does not constitute a course registration or guarantee your participation, price, or specific conditions.

4.2 You agree that by joining a waitlist, we may contact you by email regarding relevant program information, offers, and updates.

4.3 Waitlist benefits (such as early information or best prices) are offered at our discretion and may change.

5. Pricing and Payment

5.1 All prices listed on our website or in offers are in Euros (€), excluding VAT unless otherwise stated.

5.2 Payment is due upon registration or as otherwise stated during checkout. Customer access to Services is granted only after the payment is received or confirmed.

5.3 We accept payment via the payment methods specified at checkout (e.g., Stripe, PayPal).

5.4 In case of payment disputes or chargebacks without prior communication, we reserve the right to suspend or terminate access until the matter is resolved.

6. Cancellations and Refunds

6.1 Unless otherwise stated, digital content and online courses are generally non-refundable once access has been granted.
(Specific policies may vary for certain live workshops or events — in such cases, separate refund terms will be provided in the offer.)

6.2 If you have purchased a Service that includes live sessions or scheduled events and later cannot attend, please contact us. We may offer access to recordings or alternative dates at our discretion.

6a. Reimbursement by German Statutory Health Insurance (GKV)

Certain preventive health courses offered by ACTivate Life (including Qigong and Tai Chi prevention programs) may be eligible for reimbursement by German statutory health insurance providers (gesetzliche Krankenkassen).

Please note:

  1. Reimbursement is not guaranteed.
    Whether and to what extent course fees are reimbursed depends entirely on the policies of the participant’s individual statutory health insurance provider.

  2. Attendance requirements apply.
    Most insurance providers require regular and sufficient participation in the course sessions (e.g. a minimum attendance rate). Failure to meet these requirements may result in partial or no reimbursement.

  3. Participants are responsible for clarification.
    Participants are solely responsible for clarifying reimbursement conditions with their health insurance provider before enrolling in a course.

  4. Certificates of participation.
    Certificates required for reimbursement are issued after successful completion of the course and must be requested manually by email at [email protected].

  5. No payouts by ACTivate Life.
    ACTivate Life does not reimburse or pay out any insurance-related amounts. Any reimbursement is handled exclusively between the participant and their statutory health insurance provider.

  6. Private and international insurance.
    Private health insurance providers or international insurance plans may follow different rules. ACTivate Life does not provide reimbursement advice for non-statutory insurance systems.

7. Use of Content and Intellectual Property

7.1 All course materials, videos, text, graphics, and associated content are owned by ACTivate Life or licensed to us and are protected by intellectual property laws.

7.2 You are granted a non-exclusive, non-transferable, revocable license to use the content for personal, non-commercial purposes only.

7.3 You agree not to copy, distribute, share, sell, or publicly publish any part of our course materials without written permission.

8. Participation Requirements and Personal Responsibility

8.1 Participation in physical movement or exercise classes (e.g., Qigong, Tai Chi, Shaolin-based formats) assumes a reasonable level of mobility. You participate at your own risk.

8.2 If you have medical conditions, injuries, or concerns about exercise participation, we strongly recommend consulting a medical professional before engaging in any physical activity.

8.3 ACTivate Life and its instructors are not liable for personal injury, loss, or damage arising from improper application of course content or failure to follow safety guidelines.

9. Liability and Disclaimers

9.1 To the extent permitted by law, ACTivate Life shall not be liable for indirect, incidental, or consequential damages.

9.2 We do not guarantee specific outcomes or results from the use of our Services.

9.3 Our total liability in any claim arising under these Terms shall not exceed the amount you have paid for the specific Service giving rise to the claim.

10. Data Protection

10.1 Personal data processing is governed by our Privacy Policy, which is an integral part of these Terms. By using our Services, you consent to that policy.

10.2 You may withdraw consent for processing where consent is the legal basis, to the extent allowed under applicable data protection laws.

11. Communication and Electronic Notices

11.1 We may contact you by email or other electronic means regarding your account, orders, updates, and offers.

11.2 You agree that electronic communication is sufficient notice for matters relating to your use of Services.

12. Modifications to Terms

12.1 We reserve the right to modify these Terms at any time for legal, regulatory, or operational reasons.

12.2 We will publish updated Terms on the website. Your continued use of our Services after changes indicates acceptance of the updated Terms.

13. Governing Law and Jurisdiction

13.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions.

13.2 The courts of Hamburg, Germany shall have exclusive jurisdiction for disputes, to the extent permitted by applicable law.
